ARTICLE 8 : APPOINTMENT

8.1 JOB POSTINGS

8.1.1 * Prospective positions within the Bargaining Unit shall be posted on the University’s Human Resources web site.

8.1.2 * The positions shall normally be posted up to a period of ten (10) days and no less than two (2) months prior to the start of the appointment.

8.1.3 * Exceptions to normal posting procedure may arise at times.

8.1.4 The employer shall endeavour to send a copy of the posting to the Association as soon as possible.

8.2 APPLICATION FOR POSTED POSTITIONS

8.2.1 Applications for posted positions shall be submitted using the Job Application form no later than the date the posting ends and shall be accompanied by a complete updated CV. It is understood, however, that the Employer shall not refuse to consider an application filed without a C.V. if the applicant had in fact filed one during the previous session.

8.2.2 * It is the responsibility of the applicant to provide all of the information on which the decision to hire will be based, as requested in the job posting.

8.2.3 The Employer shall take into account, in the assignment of work, the course selections made by the applicant.

8.3 APPOINTMENTS

8.3.1 As soon as reasonably practical, but usually within ten (10) working days following the end of the posting, the successful candidate shall receive an offer of employment specifying the terms of employment as follows:

a) the course to be taught;

b) the date on which the appointment commences and duration of the appointment.

8.3.2 RIGHT OF FIRST REFUSAL

8.3.2.1 If a Member has taught a particular course in the previous academic year with satisfactory performance according to Article 10, the Employer shall offer a Member the right to teach one section of this particular course, without first having posted that course.

8.3.2.2 Such arrangement applies when the course would normally have been posted.

8.3.2.3 Where two or more candidates obtain a right of first refusal pursuant to 8.3.2.1, the section of the course will be awarded to the member with the most seniority.

8.4* An Employee’s appointment is effective on the date specified in the offer of employment.

8.5 APPOINTMENTS IN CASE OF POSTING

8.5.1 Each Term, after all appointments are made pursuant to the posting process, should any additional sections of courses become available, the Employer will first consider qualified applicants from the original posting process for that course prior to posting these courses.

8.5.2 When a posting is required because the course could not be filled by right of first refusal, the Employer shall first consider Members with the most seniority (as described in Article 8.8) at each campus of Toronto and of Windsor respectively. For greater clarity, a Member with seniority in Toronto has no seniority in Windsor and a Member with seniority in Windsor has no seniority in Toronto.

8.6 HIRING PROCESS IN CASE OF POSTING

GUIDELINES

8.6.1 Applicants shall be rated according to their qualifications and the requirements and other criteria set out in the posting.

8.6.2 A Member who has previously taught a specific course with satisfactory performance in accordance with Article 10 shall automatically qualify for that course and shall not be required to submit a CV.

8.6.3 Applicants lacking one or more of the required qualifications shall not be considered.

8.6.4 In order to assign courses/work at the end of the posting period, the academic unit shall establish a list of qualified applicants in decreasing order of seniority. Such a list shall contain the full names as well as the seniority of the applicants. The academic unit shall then proceed to offer the posting to applicants in the order in which they appear on the list and according to the provisions of this section.

8.7 SENIORITY

8.7.1 Each campus of Toronto and Windsor shall have its own seniority list where the seniority date of each member shall be reported. The date on the seniority list shall be the date the Member accepts their first contract in Toronto or Windsor and this date (term and year) shall remain on the seniority list as long as the member's service is not interrupted under the terms of Article 8.10. Should a member obtain a teaching contract after a period of interrupted service, the date which shall henceforth appear on the seniority list shall be the date on which the member obtains the most recent contract.

8.7.2 TIE

If a tie in seniority results, priority shall be given to applicants who have taught the course previously. If no candidate has taught the course in the past, the qualifications as listed in the CV shall be considered to select the candidates.

8.8 SENIORITY LISTS

By June 30 each year, the University shall post on its website a list of the Members of each unit, including their seniority date and their home campus. It shall remain available on the website until the new list is available the following year. Members must report errors or omissions to Faculty Affairs between July 1 and August 31 of every year.

8.9 PERIOD OF INTERRUMPTED SERVICE

8.9.1 An Employee who is not in the bargaining unit for a period of twenty-four (24) months or longer shall lose all seniority points previously accumulated unless they are on leave as specified in article 15 of this agreement.

8.9.2 * Members who have lost their seniority pursuant to Article 8.10.1 can have their seniority reinstated upon a positive decision of the Labour- Management Committee. It being understood that both parties must be in agreement for this reinstatement to occur.

8.10* ASSISTANCE WITH ACCOMMODATION MEASURES FOR STUDENTS

Effective September 1, 2024

When a member is requested to assist with accommodation measures for students during in-class examination and that such accommodation is arranged through the Academic Accommodations Service and involves additional e-mail, telephone or in-person support on the part of the member, he/she shall be paid upon request an amount of $250 per course for such accommodation assistance.
